Engagement Ring - fiancee has no choice but to leave relationship

After knowing my fiance for over two years, I decided to give up everything I had in MA and move here to be with him and get married. He gave me a ring in December, but by then the relationship was becoming abusive. I missed my daughter who was still residing in MA. When I told him I wanted to go back to be with her because I missed her, he said if I went we were over. After several more months of abuse, I finally got out. I had no choice. While I never explicitly called the wedding off, he insisted if I left we were over. Now he wants the ring back. I gave up everything to move here and I need to sell the ring to get home to my daughter. Does he have a right to get the ring back?

Engagement rings are conditional gifts. Marriage must occur for the condition to be met. The question here is who breached the agreement to marry? You could argue that he constructively breached the agreement by becoming abusive. Therefore, you have a right to the ring because you detrimentally relied on his promise to marry and moved to Texas. Of course he will argue that you breached by leaving him. Good luck.
