If the father is willing to sign a relinquishment form to terminate his parental rights, Then there should be nothing to prevent a step parent adoption. I have handled many such cases over my career. The overall cost, however, will run between $2,000 to $3,000 total. Included in that total are the filing fee, fee for the required social study, fee for the fingerprint background check for the person adopting the child, and an estimate of the amicus attorney's cost. All adoptions must have an amicus atorney appointed for the child as a part of the process. I am a board certified specialist in the field of family law.
