Legal Question in Family Law in Texas

What ethical obligation does a family law attorney have if he/she finds out that both clients who have inquired about their services to file for divorce, are married to each other.

I have two friends and both of them went to see the same attorney about a divorce. But neither one of them has paid a retainer.

Does the attorney have to tell either one or both that they are wanting to retain services?

Attorneys are not supposed to represent opposing parties in a lawsuit unless the parties waive the conflict. Waivers must be informed. If a retainer has not been paid, it is questionable whether the attorney is representing anyone.
