Legal Question in Family Law in Texas

My father an mother divorced when I was young. The courts (Polk County TX) ordered my mother to receive a little over 50.00 a month in child support in 1968 -1969. My father has never paid any child support. can either my mother or myself file suit against my father. If he passes away do we have a right to sue against his estate for the past due child supoport. What options if any are there.

You do not have the right to collect any child support, and your mother's right has been forfeited by waiting too long - the statute of limitations has run.
