How can she?

My fiance would like custody of his daughter because her mother lives in Houston while she lives with her granparents in Luffikin...She is never with her children,she let her boyfriend get drunk and crashed her only car for her and her kids..and my fiance would like his turn..his daughter is 6 and ive been in her life for about 2 yr. now.I love her and we want her to just be stable and not moved so much. Her mother has put her in 3 diff. schools and she's only in 1st gr. Please let me know the BEST way to pursue this.Thank you for your time

The legal route your fiance would take depends upon whether there is currently a court order which determines conservatorship, child support, visitation etc. If there is, then he would file a Petition to Modify the existing decree. The petition would request a change of conservatorship and other issues affected. He would request primary custody -- and the result depends on what the mother's reaction is, and what evidence your fiance produces at the hearing. If there is no current court order, then he would file a Suit Affecting Parent-Child Relationship. He would have to establish parentage of the child, and seek primary conservatorship. It is extremely difficult to pursue these options without an attorney. He should contact a family law attorney and review his options. TCL
