My Girlfriend and I are pregnant and have no plans on getting married before the baby is born. We are planing on giving the baby my last name. What I am wondering if it better legally if we should be married before the baby is born. If so what benefits would this provide.

If you get married before the child is born, there will be a presumption that you are his father. See 160.204 of the Texas Family code.
