Legal Question in Family Law in Texas

grandaughter

My daughter and grandaughter have lived with my husband, younger daughter and myself since my grandaughter's birth. Her father has never paid any child support and she has never lived with him in her two year old life, if something happened to my daughter what sort of rights would we have as her grandparents and the only family she has ever lived with?

If a biological parent is deceased, then the grandparent has some limited rights to possession and access. You would have to establish conservatorship in a Suit Affecting Parent-Child Relationship. Your daughter can name you in her will for her daughter, but it would not supercede the rights of living biological parent.
