can grandparents keep custody if parent wants child back ?

I gave up custody 6 years ago to my parents.They were leaving country and was suppose to be for 2 years. Now they have let the child live with me again. They were suppose to give custody back this week but got mad at me for something else and are threatening to take the child back. The child is in school and has been living with us for 4 months. The child does not want to go. What legal actions can be made to keep the grandparents from taking the child out of my home? What can be done to regain custody?

Is the child in Texas or Louisiana? Where are all of the parties. That will make a difference since the laws are different in each state.

Also, is there a court order that gives custody to your parents? If not, then you probably have superior rights. If so, then you must file a motion to modify the court order.

Since your parents may obtain the child or move soon, you should contact an attorney immediately. The facts that you currently have possession and the child is in school helps your case. Don't give up those rights.

You need an attorney who is familiar with interstate jurisdictional matters.

Contact a lawyer immediately. It is time to file in court and get custody back.
