Legal Question in Family Law in Texas

grandparent's rights

I have heard that some states recognize Grandparent rights in child custody cases. Does the state of Texas have any such laws?

Re: grandparent's rights

Yes but they are very limited.

If your child (the mother or father of the grandchildren) has died then you can ask for some visitation. You won't get as much as a divorced parent, but perhaps one week-end per month.

If your child is in jail for a long time, again, you can ask for visitation.

Otherwise, the courts feel that you should visit your grandchildren when your child has the grandchildren.

If you don't get along with the parents of the grandchildren, you would need to prove them unfit (a very hard burden to prove) in order to get custody.

Summary, be nice to your children since they will determine if you get to see your grandchildren.
