Legal Question in Family Law in Texas

my husband has two daughters that he see's every other weekend. The mother of his daughters is living with a guys that his daughters say beat her and they live in an apartment that there is alot of violence. The kids are not eating regularly, etc. What does my husband do to try to get full custody of his daughters because he feels they are in an unsafe environment?

He files a motion for modification, presents his evidence to a judge (or jury), and hopes they believe him. He should plan to spend about $20,000.00 in lawyer's fees, social study fees, depositions, etc.
