What's the best way to insure legal custody.
In Auguest, me and my wife of three children seperated, I left my wife and not for another women. In fact no relationship at all since the seperation. Recently she was pulled over in a other county for publi intoxication and failing to stop at a stop sign and arrested at 3:30 in the morning. Complaints from her family have led to me to find out that she doesn't spend as much time with the children that she says she spends and friends and family say she is going out with another man/boyfriend. When she didn't go to work and dissappeared, I picked up my children from daycare and school, have them now, and I am going to file a original petition for divorce seeking sole custody of the children. Question:How can I ensure that I keep custody and can have them and not make sure thier mother gets custody of them, feeling that she would run away with my children. I have bills in record that I paid for Child care, bills I paid while I left her and she was at her mothers. And copies of both citations of her being arrested in the middle of the night. She leaves for work at 6:00 am and comes home at 6:00 pm. I work overnight from 9:00pm to 6:00am. Right now, I am spending more time with children.

You can't insure, you can only present evidence and proof of your claims and leave it to the discretion of the judge. If you can prove everything you said, you might have a chance; but it is not unknown for the mom to come in all teary-eyed and remorseful and go home with as psoosessory custodian. Get a good lawyer. good luck.
