I was born in the US, I married a Brazilian fellow during a trip I made to Brazil. I got him a Visa based on this and he came to US he stayed 15 mos.in texas with me. One day, he used my credit cards, took money out of the bank and bought a one way ticket back to Brazil. Never said goodbye or anything. Then, I had a Brasillian attorney file for separation, because you have to wait 2 yrs before you can get a divorce. Well, the petition is still under another million petitions, I am still married to this guy that Im not sure is even alive! Its been over 2 years already and nothing. CAN I JUST GET A DIVORCE HERE ANE WILL IT COUNT IN BRAZIL??? I NEVER FILED HERE FOR A MARRIAGE OR DIVORCE I JUST WANT TO BE FREE FROM THI SMAN LEGALLY, NO KIDS, BUT I HAVE 401K. DO PEOPLE WHO MARRY IN FOREIGN SOIL NEED TO GO BACK THERE TO DIVORCE???

If you have lived in Texas for at least 6 months, you can file in the county you live in.

However, in the divorce petition, it states that there are no other cases pending.

If you have a case pending in another country, that is another case and it would be a lie to state otherwise.

If the case in Brazil is dismissed, you can file in Texas.

You do not need to go back to the country where you married.

You divorce where you live now.

Since he's in Brazil, you can also divorce there.
