IRS deductions

I am the primary I agreed to share the dependency exemption for a child with the mother(every other year)even though the child lives with me and I pay all expenses. Now that she is thousands in arrears on child support, can I claim the child every year without paying a lawyer to refile the arrangement? I'm more worried about IRS retribution than the spouse taking me to court.

The IRS will go against the person filing the fraudulent return. The IRS rule allows the exemption for the person providing more than 1/2 of the support. You might want to take this information to a family law attorney.
