Legal Question in Family Law in Texas

What Can I do???

Hello, My name is--name removed---name removed--From TX) and I am married to Christopher--name removed--(From HI) who serves in the US Air Force (almost 8 yrs now) We've been married (Texas) about 6 1/2 yrs and have 2 boys (4/6) and 1 more on the way. I have been a housewife for most of our marriage, but sometimes picking up small jobs to make ends meet and we are currently stationed in Okinawa, Japan.

The reason I am writing is because my husband has been an alcoholic for the past 6yrs and I now see he has no intentions on quitting. I hate having my kids in this enviroment and have mentioned divorce to my husband, but he immediately threatens to take the kids from me if I do any such thing and says things would be in his favor because he has a Great career. My question is, is there anyway I can document his drinking(like receipts) to show the judge when we go to court??? And being that I've been a housewife for the past 6yrs, what if I can't afford a lawyer? do I have to stay married??? Can you please tell me my rights?!

You need to contact the JAG office and see about filing for divorce and getting yourself relocated back in the U.S. It's rare for children to be taken from the mother, but you will have to work with a lawyer to prepare your case. Temporary support can be established when you file for divorce. Good Luck.
