He's in jail on Capitol Murder charges...

my common law husband has been behind bars since 08-30-06. i was evicted from our home 7 months later (march 07) and put our things in storage. i have found a new home and dont want to be with him anymore- do i have the right to keep all the things in storage?, or can his father show up here with the police and demand certain items be given to him? please help, this may be happening soon...

His father's rights are limited to what a judge has ordered. What does your common-law husband say he wants to do with his SHARE of the property? Is it your intention to divorce him? Or merely allow time to elapse to terminate the informal marriage? If you dispose of property (by dumping it, or by giving it to a third person) you conceivable might have to reimburse the ex. Since your ex has not been convicted, and since there have been no court orders regarding the property, I would advise a client to store the property until there is a court order.
