joint property in a divorce

If a couple that does not have a biological child together and has been slit up for one year are divorcing who is intitled to the house if both party does and has worked? Also the wife is living in the house with her daughter and the husband has been paying the house payment in full (1,224 per month) and health ins as well as auto ins for 13 months now. The wife wants him to continue paying while they live there when he wants the house he is paying for back?

Re: joint property in a divorce

Get a lawyer. The house is community property, and subject to a sale and division of the proceeds. You are being very kind paying all of the bills, but you are not obligated to these expenses. A court may order temporary spousal support, but you may well have exceeded what the court might have ordered.
