Legal Question in Family Law in Texas

Jointly held bank accounts and Marriage

This is what my husband has done. What can I do?

Take the money out of jointly held bank accounts, put it all into an account in your name alone and don't tell your spouse about it beforehand. Then let your spouse handle the problems associated with covering the bounced checks. This works best if your spouse usually writes the checks to pay the household bills,,,,,

Re: Jointly held bank accounts and Marriage

I presume this occurred in a divorce proceeding. In joint account, either party has the right to the funds. However, this was community property so you are entitled to a reimbursement for your 1/2 of these funds. You might be able to convince the judge to allow a reimbursement for any bounced check charges also. I hope you already have an attorney to help you in this.
