is it kidnapping?

If my baby's dad, who does not have the babys last name because were not married, comes to my house and we get into an argument and he takes the baby can i call the cops for kidnapping or does he have custody until i go to court?

Call the cops for kidnapping. He has no rights until defined by court order.
