what kind of visitaion would my daughters biological father get if he takes me to court? he did not come into her life until i begged at 18 months old. i have tried to work this out with him but he wants to take me to court. my husband is listed as her father on the birth certificate.

The answer to you question is complex. (1) Since the baby is under 3 yrs. old, you can agree to the under 3 provision.(2) Or, if it's agreed, you could do something that does NOT follow the guidelines of the TX Family Code.

He would have to file a paternity action to have your husband's name removed from the birth certificate and take DNA testing to prove that he is the bio. dad.
