Legal age a child can decide who to live with?

My Child is wanting to move in and live with me in North Carolina, but presently lives with Mother in Texas. Legally the Ex will not let her decide and told child that she has no rights until she is 18. I am not sure but thought that children can be heard at a certain age. I am trying to find out this answer for my Child.

I saw your question. The legal age a child can make an election in Texas is 12. That said, it is subject to a Court's decision as to the child's best interests.

At age 10, a child in Texas can generally determine where he wants his primary residence to be. There are no absolutes, and the judge is always supposed to do what he determines to be in the best interest of the child.

Carl is right -- the age is 12.

It was 10 but the Texas Legislature raised it back from 10 to 12 a couple of years ago.
