legal age to leave home

I would like to know what the legal age a teen can leave home without being made to go back home. I have a niece who just turned 16 who wants to move in with me. We need to know if she can do this and her mom not be able to make her go back home.

The only way that she can stay is that if you think her mom an't no good mom and take her to court mut if her mom say that she can go then she can live with you but the diadvantage is that mom can tell her to come home but at her age you can probley take her to court and try to get power over her so that her mom don't have say so but I need futher information just email me at [email protected] and i will get back with you

Believe it or not, this is a frequent question. From a LEGAL viewpoint, the child must remain with the parent until she reaches majority or has her disabilities removed (made an adult by the court). PRACTICALLY, few judges are going to force a 17 year old to remain at home and few policemen are going to return them without a court order. Both recognize that it is difficult to enforce this against someone who will soon be an addult.

If the mother gets a court order, however, ordering you to return the child (this could be done in as little as 45 days, maybe fewer) then the mother could have YOU held in contempt and jailed for violating the order. A parent won't often do that, but it can be done.
