Who has the legal right to custody

My husband had a court order for custody of his daughter. This was in 1993. He requested a modification in 1996. He was awarded custody, because his ex-wife was leading an unappropriate lifestyle at that time. What happened was, the ex-wife was able to go back from a period of 1990-1993, and say that my husband was not paying child support at that time, which is a true statement, because she said she didn't want anything to do with him, and they seperated. He had lost contact with her for a while. So, she obtained a court order that said his order was no good, because he owed money to her. Who has the appropriate right? When we met, he had just gotten out of jail because he refused to pay the fine regarding her order.

I would need to see the orders to see what the court ruled. Did your husband lose custody based on nonpayment of child support in 1990-1993?
