Legal Question in Family Law in Texas

Legal/

My x girlfriend get 200 dollars in child support from me for my daughter every month. she doesn't buy my daughter clothes things for school and always hassles me to buy those things. i asked her where the money was going to and she said the bills like the cell phone and the car. recently her phone was disconnected and her excuse for not bringing my daughter to me was that her car was broken, but she is constantly going out every fri and sat to a night club that i have been working at. she runs her tab up to $150 a night from what the bar staff confirms! can i take my video camera film the fact that her car does work because she uses it to get there and show that she's misusing the child support? Can i use that against her in court?

You need a certified copy of your last court document.

Then you need to follow the visitation schedule to the letter.

If she is to bring the child to you and she does not, have a witness that is willing to come to court to testify be present at the time and date that the child is to be dropped off.

Have that person present at least 3 times.

Then file contempt on her.

If she is ordered to bring the child to you, she is ordered to do it. How she goes about getting the child to you (bicycle, friend's car or taxi) is irrelevant.

If she is pick up the child at the end of the visit and she does not, then keep the kid.

If she can't provide for the child's basic needs -- food, utilities, shelter, etc. Then perhaps you need custody.

I recommend consulting with an attorney in your area that does a lot of family law.

Don't waste your time at the TX A G office. They won't help you get custody or file contempt on her.
