ex wife is moving kids (3) and her self to a 3 br 2 bath house were her mother, stepfater and brother already live, where as i have a 5 br 3 bath house. Is this grounds to go to court for custody?

The living arrangment can be an issue, how many times she has moved and if the children are being located to a differant school.

Maybe. The circumstances of the living arrangements will be important, as will the day-to-day care of the children. Discuss this in detail with an attorney in your county, as you should be careful before saying that you have significant income and can provide better housing, as it may increase your child support obligations instead.
