what do i need to do to make sure my daughter goes to my husband and not her father who still has rights to her if i were to die? her father has not been around and she wont even talk to him on the phone. she has not had contact with her father in over a year.

What you're talking about can't be done unless you terminate Dad's parental rights.
The Probate Code says that the surviving parent is the "natural guardian" of a child.
