Legal Question in Family Law in Texas

marriage licensewaiting period?

My question is: if after obtaining a marriage license, there is a 72 hour waiting period(as stated on the license), and we did not wait 72 hours before getting married...is my marriage legal? So if I wanted a divorce, would I need a divorce if I have that glitch about the waiting period?

Re: marriage licensewaiting period?

The marriage is considered a voidable marriage if you got married within the 72 hour period after the issuance of the marriage certificate in violation of the law. Meaning that you could possibly file an Annulment of the marriage, but I believe there is also a statute of limitations period on whether you must file a Divorce or Annulment, but yes you must do one or the other.
