i was marriage for almost 3 year my husband left me wen my baby girl was 3 months and now he claims to be the daddy but he s not the biologic father and he wan to get my daughter away i got and trouble with the law and my future its and the federal law hands its anything i can do to keep my baby my big sisters is the one always loock up for me shes married and she have a cristian home everything is safe for my baby if she state w my ex we dont think we ever will see her all my family leave and costarica my only closer its my sister and her husband there 2 kids please help me give me and advise thanks

From what you have written, I understand that your husband, who left you, claims that your daughter is his child. You claim that he is not. You want your daughter to live your sister in Costa Rica because you have legal problems here. Since your sister lives In Costa Rica, I am concerned whether you are a US citizen or legal resident.

If you have not been divorced, a normal way to resolve this problem would be to file a Suit Affecting the Parent Child Relationship and seek full custody of your daughter. A paternity test should resolve this issue. If your husband is declared not to be the biological father, he has no rights over her.

If there is a divorce, the divorce decree should cover these issues. A motion to modify the divorce decree may be in order.

I am not an immigration attorney and know nothing about Costa Rican law. I do not know whether your sister can take care of your daughter.

You need to consult a family law attorney to review the details with you. Also you need advice regarding immigration law, international law, and perhaps criminal law regarding your legal "troubles." Your sister should consult a Costa Rican attorney to discuss whether she can bring your daughter to the country.
