Legal Question in Family Law in Texas

I was married last September to a man from Hungary. I believe I have grounds for an annulment but am unsure. First, I thought he was 'farther along' in the process of being in this country legally. It now appears as though I am the vehicle to achieve that. Second, our marriage has not been consummated. I'm not sure if he is unable or unwilling, the end result is the same. We no longer live together and haven't for months.

Should I use fraud or impotency as the grounds for the annulment and if so, how do I word that in my pro se petition?

Annulment is limited in Texas. The grounds are listed in the TX Family Code.
