Legal Question in Family Law in Texas

My minor childs name change.

I ordered some papers on line to do a legal name change on my daughter who is a minor because I don't have enouth money to pay an attorney. I recieved a letter form the court house saying that they needed more information. When I went to the court house to find out what it is that htey needed, they said they needed premition for the babys father to do a name change. The thing is I don't know where his is. My daughter will be 5 in december and he hasn't had anything to do with her since she was about 3 months old. Is there anything I can do to change her name without his concent? My husband and I have raised her together since she was 8 months old. She thinks her name is the same as ours and I would like to change it before she starts school to avoid confusion.What can I do? Her father and I were never married.

He is going to have to be notified by substituted service. Read up on it at the law library, or contact one of the low-cost legal aid clinics or law school clinics to see if they will assist you.
