Legal Question in Family Law in Texas

parents are both military-ish

3 years ago, my ex husband was awarded sole legal and physical custody of our son. I remarried and new husband joined Army and we moved to Ft. Hood Texas from the Houston area. My ex remarried and joined the Army last year and is currently stationed abroad. My new husband and I are leaving in the next 3 months to a new duty station abroad. (Not same country as ex-husband) Because there is a chance that my ex husband could be forward deployed, is that reason enough for me to sue to get full sole legal and physical custody from my ex?

Don't know why you didn't get custody originally, but possible deployment (assuming he can make adequate arrangements for the child while he is deployed) is not enough reason to ensure you could get custody. You can try but it is not a done deal.
