Legal Question in Family Law in Texas

physical custody

i have full physical custody of my two sons. in other words i have it to where they are to live with me. my ex-wife lives in wisconsin and and i live in texas. she is planning to get the boys for the summer. what legal rights do i have that keeps her from keeping them and returning them to me.

If you have a court order granting you managing conservatorship of your sons and it establishes visitation for mom, then you have several legal options available to you if she does not return them to you. If no court orders exist, then the issue becomes much more problematic. You should formalize the custody issues as soon as possible if you haven't already. Consult an attorney.

If you have some really good reason to fear that she might not return the children, you could ask for a bond which might begin to cover legal fees to fight for their return. You would have to have proof of your concerns. The judge likely would not require a bond just because you think it might happen.
