My husband who left me right after his daughter from first wife died left me and the child we had togeather when she was 9 months old. She is now 3 1/2 and he has had very little contact with her. The last time he called was just before Christmas of 2006 and I have not heard from him since. My question is how hard will it be for my to have his rights taken from him? I do not want anything from him just a divorce and to move on. I have another child with another man and that is the man my daughter calls daddy. I do not have much money to work with that is why I have not been able to file for divorce. My husband is not a good man he has spent much time in jail and even tried to kill himself since my step-daughter passed away. She does not know him and I would like for us to have a happy life but I need to know what to do to get all this going so we can do just that. Thank You!

Terminating parental rights is not as easy as most mothers in your situation want it to be. Most often the guy would have to make Hannibal Lecturn look like a saint. The reasons you cite for termination are not likely sufficient, and it's going to cost a lot of money to try. Just get your divorce, limit his visitation to supervised visit of no more than 4 hours in the a.m. or p.m and go on with YOUR life without trying to take something from him.
