Legal Question in Family Law in Texas

My ex is planning on moving outside the 100 mile geographical restriction because her new husband got a better paying job. I have our daughter over 55% of the time and pay child support. I am actively involved with my daughter on a daily basis and her mother and I agreed to stay close for the child's benefit and well-being. I plan to file an emergency modification for the best interest of my child. What are my chances of getting custody of my 6 yr. old daughter?

I would be glad to visit with you concerning the issues you have raised in your question. The answer could somewhat depend on what Court you are dealing with since there are different perspectives depending upon the judge. I would need to know more about the facts of the case before being able to assess your reralistic possibility of attaining custody. Your initial request should be an injunction which precludes her from moving during the pendency of your modification action. I am a board certified specialist in the field of family law practicing in the general Houston area. If interested in visiting, please contact me at 713-600-5500.
