If you are only living together, then you don't need a pre-nuptial form.

You need to make sure that you never tell anyone you are married or ever fill out any paperwork (IRS tax return, lease, health insurance, car insurance) showing "spouse. If you do, congratulations -- in the State of Texas you are common law married and you need a divorce.

You can read the Family Law Statute for Texas on line for free regarding Texas common law marriage requirements.

My sister lived with a guy for 7 years and since they kept everything separate and never claimed to be married, there was no problems when they broke up.
