Legal Question in Family Law in Texas

I am in the process of getting divorce in USA .my husband abandoned the court here and left to India and apparently got married again. I don't have any evidence as he was very careful and got married in a temple without any registration.both are living together and he stated that he is married but I can not do anything about it legally.he is not even sharing the property to settle divorce.I have 2 kids from my marriage.

Can I file criminal offense based on bigamy ? Everybody knows that he is married but don't have any proof.if I file a criminal case and can not proove it can he sue me back on criminal grounds? Please advise and help me.

No. Neither of you can sue the other for a crime. Criminal matters can only be brought by the state through the District Attorney or the Attorney General.

What you can do is file for divorce.

You will need a local attorney to help you deal with the fact that your husband is out of the country and is probably not amenable to service (meaning you can't have him served with court papers while he's in India).
