Legal Question in Family Law in Texas

I am in the process of filing for divorce. My husband refuses to move out. We do not have a lease/rental/mortgage agreement because we live in my fathers rental home for free. I pay all of the utilities and bills and they are all in my name. We do not have any assets to divide. I have called the police before but because we are married and his belongings are here (clothes) they could not force him to leave. How can I make him leave as soon as possible?

You need to file a petition for divorce and get the court to schedule a hearing for the entry of temporary orders while the case is pending. Whether you are entitled to a kick out order will depend upon certain facts, which you have not provided in your question. I am a board certified specialist in the field of family law practicing in the Houston area. I would be glad to visit with you concderning your case if you would contact me directly.
