Legal Question in Family Law in Texas

Qualified Domestic Relations Order

Once the court has signed a Qualified Domestic Relations Order ordering the funds in a 401K plan to be distributed to a petitioner is there any time period in which the company/investment firm has to comply with the order?

A certified copy of the QRDO must be sent to the company for its approval.

The company is NOT required to accept a QDRO signed by a Judge. It must meet the company's requirements.

Don't just mail it to the company.

You need to make sure the right department receives it.

I'd send it certified and include your phone number and address in case they need to contact you.

It can take several months.

Of course, if you have an attorney, the attorney should do all of this for you.
