Legal Question in Family Law in Texas

hi I have a question my brother got his girlfriend pregnant last summer at the time she was 15 and he was 18. at the time her parents told her if he came around or tried to contact her they would call the police and press charges. so he did. my question is could they have really done this and if so what would have happened to him. my other question is if they end up getting pregnant again and she is 17 and he is 19 can her parents still press charges and get him in trouble. these two have been together since she was 13 and he parents have been aware that they have been going out since then

You might want to contact a criminal lawyer.

First, their actual birth dates are extremely relevant. If they are more than 3 years apart in age it makes a big difference.

The dates you give makes no sense -- first it's 15 & 18 now it's 17 and 19 -- I'm confused?

What is the worst thing that can happen to him?

If she was 15 she cannot consent to sex and he raped her. He can be convicted of statutory rape and go to prison for raping a child. He would be a convicted sex offender and have to register as such in the State of Texas for the rest of his life. It would be a nightmare for him. No one would want him to live in their neighborhood. He would have problems getting jobs.

The fact that per parents knew they were dating is irrelevant.

I don't know the limit on the statute of limitations.

I recommend that he call a criminal lawyer and discuss this matter.

Look on this website and on www.avvo.com for a criminal lawyer to talk to.

If it is safe, then he needs to establish his parental rights and get a court to allow him to visit the child.

Since she still lives with her parents, he should not get her pregnant again. She obviously relies on them for support and they do not like him.

Your brother is looking at 20% of his income going to pay for one child. If he has 2 children then 25% of his income will go to supporting 2 children. Plus, he will have to carry health insurance on the child(ren). Then he will be responsible for at least 50% of all uninsured medical expenses for the child(ren). These expenses are a lot of money. If he gets behind the interest rate is 6%. He cannot discharge these debts in bankruptcy.

If he gets behind he can go to jail for non-payment for at least 6 months. He can lose his driver's license and passport. He can ruin his credit. It can impact his ability to get a job, purchase a vehicle, purchase a home. He will never get a tax refund.
