Legal Question in Family Law in Texas

question on a divorce decree

I was divorced in 1997 and the judge ordered my ex to put 1/2 of the stock he owned in an irrevocable trust for our children. Instead my ex sold all the stock and kept the money. The Denton,TX DA told me this is considered contempt or theft, but said it was a civil matter. However, the police told me since it was ordered in my divorce it is considered theft or fraud and I can press charges. The problem is I live in Va and we were divorced in Texas. I don't know what to do or how to do it. Could someone please help?

Re: question on a divorce decree

If your husband has assets or if this was ordered as additional child support, then I would file a contempt charge and seek to have him held in contempt or at least get a judgment against him.

The biggest issue concerns the statute of limitations and whether or not you have let that pass for doing anything. A great deal will depend on how the stock matter was addressed in the divorce decree and if it was part of a settlement agreement incident to the divorce. Without actually having the documents in front of me, it's impossible to go any further.

You should retain an attorney knowledgeable in family as well as criminal law matters who practices in the court which granted your final decree of divorce in Texas.
