Legal Question in Family Law in Texas

relinquishment of parental rights

Situation: The father of 2 children signed papers in his ex-girlfriends(Mother of 2 children) attorney's office a few years back and was told he wouldn't hear anything back regarding it. Now he is remarried with another child on the way and we aren't sure if it really went through and is totally legal. I've searched the Dallas County records and there is no record of anything besides his previous divorce so I don't think it was legal. QUESTION: Can this ex come back later and try to get back child support from him or try to take him to court for child support? QUESTION: What should we do as far as getting this taken care of? His attorney that did his divorce said that signing his rights off would be the best thing because he already had 2 children with his ex wife and was paying child support to her.

Re: relinquishment of parental rights

I am confused by the parties. You state that 'his' attorney said signing off his rights was the best thing. If he had an attorney involved in the termination, then that attorney should have the files, and be able to resolve this question. If his rights were terminated, and the file was sealed, then you will not be able to locate online evidence of the proceedings. Hire a lawyer to confirm the status of the proceedings if you are unable to.
