Legal Question in Family Law in Texas

Rule 11 Agreement Family Cast

I am representing myself and entered into a Rule 11 agreement in court.

I screwed up because I thought this was only temporary and I could change it before trial.

What options do I have to change or cancel the Rule 11.

It does not comply with Texas Family Code.

I am on SSI (which is exempt as a net resource), though I did agree to pay $150 a month because my mom was with me and voluntarily wanted to give money to my son.

Also, she is temp. sole managing cons.

Also, I live in Dallas county and she in Brazoria (5+ hours away) and the agreement states I must be supervised by my mom and cannot take my son out of Brazoria or Harris counties (therefore I must sleep in a hotel), with no overnight stays, once a month, 4 consecutive days a month max, and by agreement of parties.

What are my options?

I love my son and he loves me and we have a good relationship with no history of abuse or neglect.

Even his mom would admit that.

She is mad at me because of actions regarding our personal relationship and her parents have a net worth of about 5 mil, so attorney fees are no prob for her.

I made a huge and dumb mistake.

She has only distanced me from my son (2 1/2 yrs.) since April 30,2007 because she is mad i emailed her friends.

I am very sorry, but you are right that you have made a terrible mistake. I don't know if your problem is fixable, but you REALLY need to hire a lawyer right away. (As in yesterday). Hopefully your mom will help you out. Many lawyers will work on a payment plan, but you need representation.

I assume the case is in Brazoria County. If so, try Patricia Bushman at 8978 Kirby Drive, Houston, Texas. Talk to herLegal Assistant and Office Manger - Arlene L. Mansell. 713.807.8405. She takes credit cards and does payment plans. She also is in court every day so plan on dealing with Arlene. Be sure to let them know that Fran sent you!

Good luck!
