Legal Question in Family Law in Texas

security of a house

I married into a existing home. My husband doesn't seem to believe in a will. We have been married for 5 years, and I've asked him about my security of a home if he should die. He will not talk anything about it. He has 2 grown children. What is the security of a home in case of death. And if he has made out a will leaving to his cildren, is there anything I can do about this in the event of death. Thank-you for answering this.

Re: security of a house

With children from another marriage, I would urge you to talk to an estate planning attorney also called a probate attorney.

You need to understand all your rights. With the children from another marriage, it makes everything more complicated.

Even if he has willed the property to his children, as a surviving spouse you will retain a life estate,e.g. you can live there for the rest of your life.
