Legal Question in Family Law in Texas

I am seeking a divorce from my husband. We have been separated since Sept. 2008. My husband had to relocate to Louisiana due to a probation violation. On March 6, 2009 he married another woman. They have been living together as husband and wife since that time. I am filing for divorce and I am concerned about my 401K, which is solely in my name and has been deducted from my salary since 2004. He has stated that if I pay him $1500. he will not contest the divorce. Does he have legal rights to my 401K?
