Legal Question in Family Law in Texas

my ex and i have been seperated for 3 months now and in the beginning of jan. 2012 he started dating another woman now one month later their getting married and this new woman wants him to have nothing to do with our 3 year old son so he agreed to sign over his legal rights to his parents i'm ok with that but i want to know if this would be the best legal decision for me and my son or are there other options for me in the state of texas? is there a way that i can still make him pay me child support but have no legal rites to our son without signing his rites over to his parents?

This is a very bad idea. First, he cannot "sign over" his parental rights to anyone. Only a court can do that. He can give them certain rights under a new law, but you could (and should) object to that.

He might be able to relinquish his parental rights, but that would be up to the court and some courts will not do that easily. If he did that, then you would have ALL of the rights and I doubt that his parents will encourage him to do that.

If he tried to do anything like this, then you should talk to a qualified family law attorney to obtain a comfort level with your rights and your legal situation. The attorney will need much more information than is in your post.

Good luck to you.
