If married and your spouse had an affair, and out of that affair a child was born, can the married spouse sign over his rights?

No. Along with fathering a child comes certain legal rights and obligations as well as parental rights and obligations. A judge is not going to allow someone to surrender their legal obligations just because they do not want to exercise their parental rights.
