single dad working

my son got sole custody of his three boys last year, he has try to work at a 6;00 hr job and with no health insurance. so he has when back to driven a truck over the road.(home every weekend) can the xwife take the boys from him?

The wife is certainly feel to file for a modification of their last court ruling.

It sounds like the family situation has changed (your son no longer is there with the children - he is leaving them with someone else while he is gone) so she has grounds to start a modification.

Whether or not she would be successful, is another question.
