Legal Question in Family Law in Texas

If my spouse had their attorney draw up the divorce papers, I agreed to the terms and due to nonpayment my spouses attorney will not file the papers can I do that myself? If my spouse refuses to sign them as a stall tactic and I get the divorce without their signature? I have been trying to get this completed for a year and I have agreed to all demands I just want to move on. I could not afford an attorney that is why I complete the process myself of filing now I want my divorce. I am in Texas.

For an uncontested divorce, both parties must sign the paperwork.

There is a filing fee, most counties charge under $300.

Beware of the kits sold in office supply stores, advertised on t.v. and radio. The kits advertised by companies outside of Texas are not prepared by Texas attorneys! The ones that I've seen do not look look right to the Texas judges. Also, they do not contain the required Texas forms that the Texas judges require!

If you have nothing, you might try a local law school or a pro bono clinic in your area. Check the State Bar of Texas website for possible places that might help you.
