Legal Question in Family Law in Texas

Terminated Paternal Rights

While the child was in the states custody the paternal rights were terminated in agreement with CPS and the judge only. The child was returned to the mother and the mother has sole custody again of the child. Can the mother who did not terminate the paternal rights go and now request child support?

Re: Terminated Paternal Rights

The parental rights were terminated "in the best interests of the child". Once the obligor's parental rights were terminated, he had no further obligation to pay child support. I presume no order was obtained for delinquent child support at the termination proceedings; so, legally, there is no delinquent child support.
