Legal Question in Family Law in Texas

uncontested divorse after 30 years

My husband are wanting an uncontested divorce, but have property between us that needs to be separated. We have a business acquired during our marriage, a house (paid off), a building that houses our business (equity loan of $25,000.00), business assests, household possessions, plus savings accounts. How can we arrive at a value of property to divide? I would like my maiden name back as well...How much will that cost? What would be the cost to draw divorce papers and settle?

There is no definitive answer to what it will cost because that depends upon how much work must be done - whether hiring a business appraiser or real estate appraiser is necessary, etc. To a large degree, the cost is dependent upon the attitude of the opposing party - an uncooperative spouse raises the cost for both parties.

I suggest you consider the collaborative law approach to the divorce. You can find info on my website (www.northtexasfamilylawyers.com) and the site for the Collaborative Law Institute of Texas.

I suggest you consult with an attorney because a division of marital property is final in Texas - neither party has the right to later change it so it is very important to handle the situation properly.
