Is the document filed? The existence of a commonlaw marriage is presumed when certain facts are proven. The document you have is prima facie proof of those facts. The Texas Family Code provides for the marriage to dissolve 'informally', just as it was created. It is cleaner and safer to terminate the marriage through the courts.
